Crispshot is operated by 1601297 B.C. LTD., a company incorporated under the laws of British Columbia, Canada. References to "Crispshot", "we", "our", or "us" in these Terms refer to 1601297 B.C. LTD.

2. Acceptance of Terms

By accessing or using Crispshot ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

3. Description of Service

Crispshot is an AI photography service that turns a photograph you upload into professional headshots. The Service includes:

• Headshot generation from a single uploaded photo (requires credits)
• A selection of studio styles, framings and output resolutions
• Download of finished headshots as full-resolution JPG files
• A library of the headshots you have generated

4. User Accounts

To use certain features of the Service, you must create an account. You are responsible for:

• Providing accurate and complete information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

5. Credits and Payments

Certain AI-powered features require credits. Credits can be purchased through the Service:

• 1 credit = $1 USD
• Credits are non-refundable once purchased
• Credits do not expire
• Credit costs for features are displayed before use

All payments are processed securely through Stripe. By making a purchase, you agree to Stripe's terms of service.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorized access to any part of the Service
• Interfere with or disrupt the Service
• Use automated means to access the Service without permission
• Share your account with others

7. User Content

You retain ownership of the photographs you upload, and you own the headshots the Service produces for you. You may use them commercially. By using the Service, you grant us a licence to use your submitted content solely to:

• Operate the Service and run the image model on your behalf
• Store your uploads and results so they remain in your library
• Create aggregated, anonymised analytics (no personal data or images shared)

You must have the right to upload every photograph you submit. Do not upload photographs of other people without their consent, and do not use the Service to depict anyone in a false or misleading way.

8. AI-Generated Images

Headshots are produced by a machine learning model. Output varies with the photograph you provide and is not guaranteed. In particular:

• Likeness is preserved as closely as the model allows, but results are not exact reproductions
• Fine detail such as jewellery, text on clothing or background objects may be altered
• Results are not deterministic — the same photo can produce different output
• A poor source photo produces a poor headshot

Credits are consumed when a run completes, including runs whose output you decide not to use. Runs that fail or are cancelled are not charged. Do not present generated headshots as unaltered photography where that distinction matters, such as identity documents or press photography.

9. Disclaimer of Warranties

The Service is provided "as is" without warranties of any kind, either express or implied. We do not guarantee that:

• The Service will be uninterrupted or error-free
• Generated headshots will be accurate or suitable for your needs
• Results from following AI recommendations are guaranteed

10. Limitation of Liability

To the maximum extent permitted by law, 1601297 B.C. LTD. (operating as Crispshot) shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of the Service.

11. Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms. You may also delete your account at any time through the settings page.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein. 1601297 B.C. LTD. is incorporated in British Columbia, Canada.

13. Changes to Terms

We may update these terms from time to time. We will notify you of significant changes via email or through the Service. Continued use after changes constitutes acceptance.
